IAPP published an article that I authored on “How could Trump administration actions affect the EU-US Data Privacy Framework?” My sense is that the general actions to date do not directly affect the core law, regs, and orders that support the adequacy decision for DPF, and any judicial review by the European Court of Justice would take some time to mature. The key issue is what actions will the Trump administration and the European Commission take going forward? Both sides have a strong interest to maintain the DPF adequacy decision for cross-border data flows, which underpins $2 trillion annually in trade in services between the US and Europe.
